Four offences may not apply to become MPs or senators!!



On Friday,constitution writer reviewed the qualification

 for holders of political office,said the Constitution Drafting
 
 Committee (CDC) spokeman ,Gen Lertrat Rattanavanich.

They decided that politicians who have been removed

 from office for four offences may not apply to become

MPs or senators under Section 111(5) of the draft.

The four offenses are.

1.Being unusually rich

2.Acting in ways that indicate corruption running counter

to duties.

3.Acting in ways that may demean public office,or

4.Acting in ways that indicate corruption against

judicial positions.

So Thaksin Shinawattra and his sister Yingluk will

likely disappear from the political scene for good based

on the latest revision of the constitution draft.

Section 111 (8) also ban for life person who have received

The “red cards” during an election which having judged

by court or a legitimate order to have caused an election

to be unfair.

 

For minor offences ,the ban is five years.They include acting

unethically ,falsely declaring assets,or having been removed

from office for deliberating exercising power in violation of

the constitution or laws.

Most of the 220 politicians banned their parties were dissolved

in the aftermath of the 2006 coup so the so-called Houses

no 109 and 111 would be able to return.

The provision were need because Section 35 (4) of the interim

charter required that the constitution drafters design

mechanism that ban corrupt politicians for good.

The fugitive Ex-Prime Minister Thaksin Shinawattra

can not  come back to become MPs since he was ruled

guilty by the one-tired Supreme Court for politician

for being unusually rich and his assets were seized.

He was found guilty of deliberately his power

and duties illegitimately when he allowed his wife

to join a bid for state land plot on Ratchadaphisek

Road in Bangkok.

 

If the revised constitution draft is accepted Ms.Yingluk

can not become MPs too because she was impeached

retroactively by the military-appointed National

Legislative Assembly (NLA) for dereliction of duty

for her role in the rice –pledging scheme.She also face
 
criminal charges related to the case.

 

In my viewpoint,I support the point to prohibit the politicians

who rule guilty from the four offences above to become MPs

 or senators because we need good politicians to go to the

parliament and do their duty for the country benefit not for

their benefit.

I think this reviewed to adjust the qualification of the

 politicians is a good one and intend to improve the quanlity

of the politicians and it will make more clean in the political

climate.

It is the best news for many of Thai people who want to see

a better Thailand that Thaksin and Yingluk can not become

MPs and Prime Minister again so that Thailand will at least

end of the political conflict in the society.

I hope this is the first step and in the end we can go to

the true and sustainable democracy that we all need.
