The copyright law, which took effect on Tuesday, replace
the
original one which was in use for 21 years and needed
amendments to better protect copyright holders, the Department
of Intellectual Property director-general Malee Choklumlerd
said.Violatiors of the law,if found guilty by the court, must pay
up two times the
damage value.
Authorities are warning citizens to think carefully
before sharing
information online as they may violate copyright laws
and face
servere punishment.
The law is aimed at protecting copyright holders and technology
designed to
protect the copyright. For example music which is
encrypted with codes ,or pictures where the copyright is protected
by a warermark.
Wrong and Rights.
What you can and can’t do under the amended Copyrighr
Act.
Can do :
1.Share copyrighted photos through social media for
personal
use, though credit to copyright holder is required.
2.Use copyrighted photos for education purposes such as
reports or homework ,though credit required.
3.Use copyrighted content and photos for commercial
purposes,
though permission from the copyright holder is required.
4.Broadcast a video clip for commercial purposes,though
a
credit to copyright holder is required.
Violators of technological copyright protection such as
hacker who foreibly gain access to copyrighted content
or those who delete a picture’s watermark for their own
benefit could face 10,000-100,000 baht in fines. If the
technology violation has commercial purposes, the penalty
will rise to 50,000-400,000 baht. They also face a term in
prision of three months to two years.
Ordinary copyright violations could be liable to fines
of
20,000-200,000 baht, and for those who breach copyright
for commercial purposes ,fines of 100,000-800,000 baht
and jail term of six months to four years are in
prospect.
These heavy penalties serve as warnings, especially for
internet surfers and Line app user, that people must
think
carefully before sharing content in cyber world.
Internet users must be more careful when they copy text
or photos, protected under copyright law,and share them
online or paste them on their Facebook pages.
In fact, even sharing “good morning” sticker via Line
could
violate the law if those who create the stickers want to
claim
their right.
People must carefully study the usage conditions to see
to
what degree they allowed to use the content.
Generally if they use one or two photos which hold no
significant value and do not use them for commercial
purposes, their acts will be considered as “fair use”
without violating copyright law.
Internet users are not required to ask permission from
text or photo owners if they want to use their content
private or academic purposes.
However, people should always give credit to content
owners and make sure the usage will not hinder any
benefits to which owners have rights.
Embedding YouTube clip to blog without permission
could be seen defying the law also.
Hope information useful for internet user.
Best Wish.
