The public assembly law takes effect!!


 
On Thursday,the public assembly law requiring people

wanting to stage a demonstration to notify the authorities

24 hours in advance takes effect.

Prime Minister Prayut Chan-o-cha has warned activists

that it will be strictly enforced to prevent political turmoil.

“This law will be strictly enforced to prevent the type of

nuisance and violence that happened in the past,” said

Gen Prayut,”It’s not possible to have it all-happiness,

equality ,democracy-without giving us the the tools”

Human rights groups say the law gives broad powers

to the authorities to prohibit public assembly on vague
and arbitrary grounds.

“This law violates the rights of the people.We want

 this act revoked,” said Nutchapakorn Nummueng,

a representative of iLaw,a legal watchdog and rights

advocacy group.But Gen Prayut argued the law was

 intended to ensure that public gathering do not escalate

and spin out of control.

“If you had not want (us) to get tough (about demonstration),

then this law would not have had to be written in the first place”.

Last year Gen Prayut stressed that a law on public gathering

was necessary to ensure national peace and put an end to

political conflicts.

Protest organizers will now be required to notify police

 supervising the area of their rally venue at least 24 hours

before the assembly.They must also state the propose of the

gathering and how long it will last.

Anyone who considers the demonstrator might creat a public

nuisance can petition the Administrative Court or courts

of justice.

The law also bans public gathering that block the entrances

or exits of government offices,airports,ports,bus and train

stations , or hospital ,or disturb their operation.

The law details a variety of penalties,including up to 6 months

in prision and a 10,000 baht fine for protesting without police

permission and up to 10 years in prision for any disruption

of public service ,such as public transportation,

telecommunications, water and electricity supplies.

Protesters who ignore police orders to leave a site could

face up to a year in prision and a 20,000 baht fine ,while

protester armed with guns,explosives or similar weapons

could face-up to 5 years in prision and 100,000 baht fine.

The bill was proposed by the police department and won

a unanimous 182-0 vote in the National Legislative Assembly

before being published last month in the Royal Gazette,

which decreed the law would take effect August 13.

As the reason for the law is to rule the right for public gathering
 clearly to conform with international criteria about citizen’s right

and political’s right .To make the public gathering in peaceful ,

prevent the type of nuisance and violence that happened in the

past .Make the public gathering cause no effect to
national security.

So I agree with this act,the point to concern is how to

 use the act effectively and do not effect citizen’s right.

Including in the law is the point for authorities to

1.Create the convenience for the gathering.

2.Peaceful of people live near the gathering.

3.Security of people who join the gathering.

4.Convenience of the traffic in the place,and near the place

gathering.

5.Condition for activists who gathering and protester organizer

who control the activists.

So I hope this law will help public gathering in peaceful and

provide the benefit for activists and the country and can end

political conflict in the future.
