According to the the new draft charter,there wiil be a
new
Unit call the Ethic Commission.The authorities of it
which will be protected by law and also under
the law are to :
1.Set standard for ethic and morality of politians,
upper government management level and local politians.
2.There will be a committee in the organization that
investigate state
authority.
3.Examime and verify ethic and morality of public
person,
Identify guilty of these person and send the result to
the senate
to relieve meanwhile the Election Commission of Thailand
can set a new election for substitution.
4.Disclose the result that they identify to the public.
Public persons and sector whose the Ethic Commission
will use
authority to idenfy are :
1.Politicians including public person who involve in the
state power.
2.Government sector.
3.Private sector who have contract with the state
agency.
Structure of the Ethic Commission :
There will be
1.Five committee which come from appointment of group
of eleven persons
appointed and guarantee by the Senate.
2.Fifty five members come from appointed of the
committee
which guarantee.
Five committee will not get salary but they will receive
remunerate
and necessary expenses.
Process of their duty to investigate defendant
1.Request
2.Defend the allegation
3.Evidence from both parties
4.Postpone time period
5.Identify guilty send to the Senate ,
if not guilty the
defendant can recriminate.
Final rule are not complete yet till the act prove by
the
Cabinet about next three month from now.
The Ethic Committee and the process of investigation
can make politicians ,government sector and private
sector
carefully play their role which precarious to the ethic
and
morality because public society will keep an eye on them
although they are ruled guilty or not ,they will be
disreputabled, people will not trust them and they will
find
difficult to be back in the position again.And if ruled guilty
they must go to the court in the end.
Controversies about the Ethic Committee
There are three units of the government sector that play
relate role before such as
1.Office of the National Counter Corruption Commission.
2.The National Human Rights Commission of Thailand.
3.Office of the Ombudsman Thailand.
So in forming and set the rule we must make sure that
all these state organization may not have conflict among
each others but can do their duties to promote and
incentive
all together.
What will we get from the Ethic Commission is depend on
all Thai citizens
Since the goal of the unit is to create ethic and
morality to set
criterion for Thai society according to the fact that
some of
politicians and Thai citizens use loophole of the law to
corruption and
make their own benefit .
The Ethic Commission
will be successful in their duty or not
depend on
1.Standard ethic and morality for Thai citizens should be set
and send spread wide to the public so that everyone
should know and practice.
2.Thai citizens should practice these as the goal in
every day
life among each
other.
3.Thai citizens should provide data,information among
each
others and send them to the Ethic Commission to be
useful to
investigate in the wrong area.
4.Politicians must adapt themselves to do for country
benefit
rather their own.
If all parties and Thai citizens corperate well among
themselves
with the same goal, I believe we can create etic and
morality to
our society and our country can develop more.
